Terms of Service

By accessing or using the platform, you agree to be bound by these terms. If you do not agree, do not use NAK-ID. 1. About NAK-ID NAK-ID (Naam Aur Kaam Identity Document) is an online platform accessible at nakid.in. It provides independent creators with a timestamped, permanently recorded proof of creation for their original works. When you register a work on NAK-ID, a certificate is issued and stored on the Internet Computer Protocol (ICP) blockchain, creating a verifiable, tamperproof record of your authorship at that moment in time. NAK-ID is not a copyright registration service. It does not confer legal title to your work, replace registration with the Copyright Office of India, guarantee any legal outcome, or constitute legal advice of any kind. Copyright in India arises automatically at the moment of creation. NAK-ID gives you the means to prove it. 2. Acceptance of Terms By creating an account on NAK-ID or using any of its services, you confirm that: • You are at least 18 years of age, or have the consent of a parent or guardian; • You have read, understood, and agree to these Terms of Service; • You agree to comply with all applicable laws of India, including the Information Technology Act, 2000 and the Copyright Act, 1957; • You have the legal capacity to enter into a binding agreement. 3. Account Registration NAK-ID uses Internet Identity (id.ai) for authentication. You may sign in using Google, Apple, Microsoft, or a passkey — but Internet Identity does not share any of that information with NAK-ID. NAK-ID receives only a unique anonymous identifier specific to your account on this platform. We never see your name, your email address, your password, or which method you used to sign in. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. NAK-ID is not liable for any loss arising from unauthorised use of your account. You must notify NAK-ID immediately at hello@nakid.in if you suspect any unauthorised access. NAK-ID reserves the right to suspend or terminate accounts that are found to be in violation of these Terms. 4. Your Content and Ownership You retain full ownership of all works you register on NAK-ID. By registering a work, you grant NAK-ID a limited, non-exclusive, royalty-free licence solely to store, process, and display the information you submit for the purpose of generating and maintaining your certificate and public portfolio. NAK-ID has no claim over your work. No rights are transferred. No licence to use your work commercially is granted to NAK-ID or any third party by virtue of registration. By submitting a work, you represent and warrant that: • The work is your original creation; • You are the rightful owner or have obtained all necessary rights and permissions; • Registering the work does not infringe the intellectual property rights of any third party; • The work does not contain content that is unlawful, defamatory, obscene, or otherwise objectionable under Indian law. NAK-ID is not responsible for verifying the originality or ownership of any work submitted. The certificate is a record of the submission, not a declaration of ownership by NAK-ID. 5. Permanent Records and Immutability Records created on NAK-ID are written to the Internet Computer Protocol blockchain and are designed to be permanent and tamperproof. This means: • Certificates cannot be edited after issuance; • Certificates cannot be deleted by you or by NAK-ID; • The timestamp recorded is the time at which the submission was processed by the platform. You understand and accept this permanent nature before submitting. A confirmation screen is shown prior to every submission for this purpose. Do not register a work if you do not wish it to be permanently recorded. 6. Credits, Payments, and Refunds 6.1 Free Tier Every account is provided with 5 credits at signup at no cost. These credits do not expire. 6.2 Paid Credits Additional credits may be purchased in packs at prices displayed on the Pricing page. All prices are in Indian Rupees (INR). Applicable taxes will be charged as required by law. Purchases are processed via Razorpay and are subject to Razorpay's own terms. 6.3 Credit Usage Credits are consumed at the time of registration. The number of credits required depends on the file type registered: 1 credit for PDF or Image, 2 credits for Audio, 3 credits for Video. 6.4 No Refunds All credit purchases are final. NAK-ID does not offer refunds for purchased credits, whether used or unused, except where required by applicable Indian law. If you have a dispute with a payment, contact hello@nakid.in and NAK-ID will investigate in good faith. 6.5 Promo Codes NAK-ID may issue promotional codes that grant credits to users. Each promo code may be used once per account. NAK-ID reserves the right to expire, modify, or revoke promo codes at any time without notice. 7. Prohibited Conduct You must not use NAK-ID to: • Register works that you do not own or have rights to; • Register content that infringes the copyright, trademark, or intellectual property rights of any third party; • Register content that is unlawful, obscene, defamatory, fraudulent, or harmful; • Attempt to circumvent, hack, or interfere with NAK-ID's systems or security; • Use automated scripts, bots, or scraping tools to access NAK-ID; • Impersonate any person or entity, or misrepresent your affiliation with any person or entity; • Use NAK-ID for any purpose that violates any law of India or any applicable jurisdiction. NAK-ID reserves the right to take appropriate action, including account suspension, in response to violations of these terms. 8. Public Portfolio Your registered works are displayed on your public NAK-ID portfolio page, accessible at nakid.in/@[username]. The portfolio shows your registered name, work titles, descriptions, certificate IDs, and registration dates. Your actual files are never shown publicly. By registering a work, you agree that this information will be publicly accessible. If you do not wish information about a work to be publicly visible, do not register it on NAK-ID. 9. Intellectual Property of NAK-ID The NAK-ID name, logo, tagline, platform design, code, and all original content created by NAK-ID are the intellectual property of Lakshya Datta. Nothing in these Terms grants you any right to use NAK-ID's branding, trademarks, or proprietary materials. 10. Limitation of Liability To the maximum extent permitted by applicable Indian law: • NAK-ID provides its services on an 'as is' and 'as available' basis without warranties of any kind, express or implied; • NAK-ID does not warrant that the platform will be error-free, uninterrupted, or free from loss of data; • NAK-ID is not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or failure to achieve any particular legal outcome; • NAK-ID's total liability to you for any claim arising out of or in connection with these Terms shall not exceed the amount you have paid to NAK-ID in the three months preceding the claim. Nothing in this clause limits liability for fraud, death, or personal injury caused by NAK-ID's negligence, which cannot be excluded under Indian law. 11. Indemnity You agree to indemnify, defend, and hold harmless NAK-ID, its operators, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal costs, arising out of or in connection with: • Your use of NAK-ID; • Your violation of these Terms; • Your infringement of any third party's intellectual property or other rights; • Any content you submit to NAK-ID. 12. Third-Party Services NAK-ID uses third-party services including Google (authentication), Razorpay (payments), and the Internet Computer Protocol (permanent record storage). Your use of these services is subject to their respective terms and privacy policies. NAK-ID is not responsible for the conduct, availability, or content of third-party services. 13. Modifications to the Service and Terms NAK-ID reserves the right to modify, suspend, or discontinue any part of the platform at any time. NAK-ID also reserves the right to update these Terms. When material changes are made, NAK-ID will notify users via email or a notice on the platform. Continued use of NAK-ID after notification of changes constitutes acceptance of the revised Terms. In accordance with the IT Rules, 2021, users will be informed of any change to the rules, regulations, privacy policy, or user agreement at least once a year. 14. Termination You may stop using NAK-ID at any time. NAK-ID may suspend or terminate your account if you violate these Terms or if continued operation of your account poses a risk to the platform or other users. Upon termination, your access to your dashboard and files will cease. However, because certificate records are written permanently to the ICP blockchain, the public certificate records associated with your account cannot be deleted. 15. Governing Law and Jurisdiction These Terms are governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. 16. Grievance Officer In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, NAK-ID designates the following Grievance Officer: Name: Lakshya Datta Email: hello@nakid.in Address: Gurugram, Haryana, India Grievances will be acknowledged within 24 hours and resolved within 15 days of receipt, in accordance with applicable law. If you are not satisfied with the resolution, you may appeal to the Grievance Appellate Committee (GAC) at gac.gov.in within 30 days of receiving NAK-ID's response. 17. Miscellaneous Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and NAK-ID with respect to your use of the platform. No Waiver: NAK-ID's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Language: These Terms are written in English. In the event of any conflict between an English version and a translated version, the English version shall prevail. 18.
